Privacy Policy

1. General disclaimer

PAWA SRL (hereinafter “SAILPEAK”) respects the privacy of its Users in accordance with article 3 of the General Conditions of Use.

SAILPEAK processes the personal data transmitted to it in accordance with the legislation in force, and in particular the law of 8 December 1992 relating to the protection of privacy and its implementing decrees.

Access to the Site implies full and unreserved acceptance by the Internet user of this Privacy Policy or Privacy Charter (hereinafter the "Charter"), as well as its General Conditions of Use. The User acknowledges having read the information below and authorizes SAILPEAK to process, in accordance with what is specified below, the personal data that it communicates in the context of the use of the Site.

SAILPEAK reserves the right to modify or supplement the Charter and to update it at any time by informing Users.

This Confidentiality Policy/Privacy Charter is valid for all the pages hosted on the Site and for the recordings of this Site. It is not valid for pages hosted by third parties to which SAILPEAK may refer and whose privacy policies may differ. SAILPEAK cannot therefore be held responsible for any data processing on these third-party sites.


2. Controller

Access to the Site requires the communication of certain personal data, such as surname, first name, postal address, e-mail address, etc.

For the remainder, SAILPEAK is in no way responsible for the data hosted from third-party companies or solutions to which SAILPEAK appeals, such as Webflow; which remain subject to their respective terms and conditions and privacy policies.


3. Information collected


3.1. Data that is transmitted to SAILPEAK by the active intervention of the User

By completing the forms provided for this purpose when registering as a User or once registered, the User allows SAILPEAK to record and store for the purposes mentioned in point 4, the following information:

  • identification data, such as name of User, password, first and last name, email address, date of birth and physical contact information,
  • communications transmitted through the Site, such as messages sent to Users;
  • communications to SAILPEAK;
  • additional information that SAILPEAK asks the User to send to identify it, or if SAILPEAK suspects the User of violating any of the provisions of this Charter;
  • any other information voluntarily transmitted to SAILPEAK by the User for a specific purpose.


3.2. Data that is transmitted to SAILPEAK automatically when consulting the Site


3.2.1. Cookies "

In order to facilitate navigation on the Site as well as to optimise technical management, the Site may use “cookies”.

A "cookie" is a small file containing information saved by a website on the User's computer or an application on the smartphone. This "cookie" can be retrieved during a subsequent visit to the same application or site. The “cookie” cannot be read by a website other than the one that created it. The Site uses "cookies" for the purposes of proper administration of the Site, in particular to record the User's browsing preferences, or to obtain information relating to the pages consulted and the dates and times of consultation.

3.2.2. The information recorded on the servers consulted

When the User access the Site, the servers consulted automatically record certain data that are not made publicly visible on the Site, such as the type of domain with which the User connects to the Internet, the IP address assigned to the User (when connecting), the date and time of access to the Site and other data relating traffic, location data or other communication data, pages viewed, type of browser used, platform and/or operating system used, search engine and keywords used to find the site, ...

However, no personal data allowing the User to be identified is collected through these recordings. This information is only kept for statistical purposes and to improve the Site.


4. Purposes of processing


4.1. General purposes

Without prejudice to what has been specified in point 3.2. concerning the data transmitted automatically, the Site collects, stores and uses the personal data of its Users for the following purposes:

  • to establish, perform and conduct the contractual relationship with the User;
  • to analyze, adapt and improve SAILPEAK's services, content or advertisements;
  • to allow the User to receive emails concerning the organization of the execution of the Service;
  • to process service requests from the User ; 
  • to respond to requests for information;
  • to inform them about changes to the Site and its features;
  • to get in touch with them as part of the operation of the Site;
  • for all other purposes for which the User has given his express consent.


4.2. Communication to third parties

Personal data, within the limits of the provisions of this article, are not intended to be communicated to third parties other than:

  • Third-party tools that SAILPEAK expressly uses;
  • Persons whose intervention is necessary for the purposes of proper performance of the contract;
  • Persons whose intervention is necessary to achieve one of the purposes mentioned in this Privacy Policy / Charter;
  • Competent public authorities when required by law.

4.3. Transfer to a non-EU country

SAILPEAK only transfers data to a country that is not a member of the European Union when this country provides an adequate level of protection within the meaning of the law of 8 December 1992 relating to the protection of privacy, or within the limits permitted by this same law, for example by ensuring the protection of data by appropriate contractual provisions.


5. Security

In order to guarantee optimal security in the possible transfer of bank data, SAILPEAK uses secure services that meet very high standards in terms of security, in particular using the "SSL" (Secure Sockets Layer) protocol.

Other personal data is not transmitted securely. SAILPEAK has however implemented security policies so that the servers hosting the processed personal data prevent, as far as possible:

  • unauthorized access or modification of this data;
  • improper use or disclosure of such data;
  • unlawful destruction or accidental loss of such data.


SAILPEAK employees who have access to this data are subject to a strict obligation of confidentiality towards them.

However, SAILPEAK cannot be held responsible in the event of misuse of this data by a third party despite the security measures adopted.

Offenses against the confidentiality, integrity and availability of computer systems and data which are stored, processed or transmitted by these systems, or the attempt to commit one of these offenses, are punishable by imprisonment for three months to five years and a fine of twenty-six euros to two hundred thousand euros or only one of these penalties.


6. Shelf life

SAILPEAK will normally retain the personal data of its Users for the duration necessary for registration as a User and for the duration of the registration. SAILPEAK may also continue to hold personal data concerning the unsubscribed User, including any correspondence or request for assistance addressed to SAILPEAK, in order to be able to answer any questions or complaints that may be addressed to it after unsubscription, and in order to comply to all applicable laws, particularly in tax matters, the retention of information relating to payments carried out.


7. Rights of the data subject

The User may also request, free of charge, to rectify and, if necessary, request the deletion of all his personal data, with the exception of those that SAILPEAK would be legally required to keep, from the SAILPEAK database by sending a written request, accompanied by a copy of his identity card or passport, to the controller at the following email address: contact@sailpeak.com

SAILPEAK will then take the necessary steps to meet this request as soon as possible.

8. Note regarding minors

Persons under the age of 18 and persons who do not have full legal capacity are not authorized to use the Site. SAILPEAK asks them not to communicate their personal data to it.
